Terms of Service
Effective date: 1 January 2026. These Terms of Service ("Terms") form a contract between you and VendMizer ("we", "us") governing your use of VendMizer and our products. By accessing this site or purchasing our products, you agree to these Terms; if you do not agree with any part, please do not use the site or the products. You must be at least 18, and if you accept on behalf of an organization you confirm you are authorized to bind it. This is a general template, not legal advice.
1. Definitions
"Products" means our software (the free version and VendMizer Pro) and related services. "Pro" means a paid VendMizer Pro license. "You" means the person or organization using the site or the Products.
2. Products and licenses
The free version of the software is distributed under an open-source licence (the GNU General Public License, version 2 or later); nothing in these Terms limits any right that licence grants you for the free version, and where they conflict as to the free version, that licence prevails. The restrictions below — no reselling, sublicensing, or misrepresenting the software as your own — apply to VendMizer Pro and to our names, branding, and non-code assets. A paid VendMizer Pro license is granted per activated site and does not expire: it includes the right to use Pro and to receive product updates for the life of the product; if we ever discontinue the product we will give reasonable notice. Priority support is included for the first year after purchase and can be renewed annually, but a support renewal is never required to keep using Pro or to receive updates.
3. Accounts and the Account Center
Some features require an account or a license key. You are responsible for the accuracy of your account details, for keeping your credentials and license keys secure, and for activity under your account. Please tell us promptly of any unauthorized use.
4. Purchases and billing
Payments are processed by our checkout provider; we do not store your card details. Prices may change, but changes never apply retroactively to a purchase you have already made. Applicable taxes may be added at checkout. If you choose to renew priority support after the first year, the optional renewal terms — including whether it renews automatically — are shown at checkout.
5. Refunds
Purchases are covered by our money-back guarantee, described in the Refund Policy on this site.
6. Acceptable use
You agree not to use the site or Products to break the law, infringe the rights of others, probe or disrupt our systems, or distribute malicious code.
7. Your submissions
If you send us feedback, feature requests, or other content (for example through the feature-request or contact features), you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and improve the Products, without obligation to you and without it being treated as confidential. Feature requests and similar submissions may be published on the site and voted on by others. Do not submit anything unlawful, infringing, confidential, that identifies another person without their consent, or that you do not have the right to share. We may edit, decline to publish, or remove any submission at our discretion.
8. Third-party services
The site and Products rely on third-party services (for example our checkout and payment provider and, where you enable them, analytics or other integrations). Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them. When you install and configure the Products on your own site, you decide which third-party services (such as payment gateways, shipping carriers, or currency APIs) to connect, and you are the controller of the personal data processed through them on your site; each such service is governed by its own terms and privacy policy, and we are not a party to, or responsible for, that processing on your site.
9. Intellectual property
The site, the Products, and our names and logos are owned by us or our licensors and are protected by law. These Terms grant you a license to use the Products, not ownership of them.
10. Disclaimer and limitation of liability
The site and Products are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. If you deal with us as a consumer, this disclaimer does not affect the statutory guarantees you have that the Products will be as described and of satisfactory quality; those rights continue to apply. To the maximum extent permitted by law, our total liability for any claim related to the site or Products is limited to the greater of (a) the total amount you paid us for the Product giving rise to the claim, or (b) the amount you paid us in the twelve months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law — including liability for death or personal injury caused by negligence, for fraud, or for a consumer's statutory rights.
11. Governing law and disputes
These Terms are governed by the laws of State of Oregon, Corvallis, without regard to conflict-of-law rules, and the courts of that place have jurisdiction — except that, if you deal with us as a consumer, you keep the benefit of the mandatory protections and courts of your country of residence. Please contact us first so we can try to resolve any dispute informally.
12. Changes
We may update these Terms; the current version is always published on this page, with the effective date above and material changes noted. Continued use after a change constitutes acceptance.
13. General
If any provision of these Terms is held unenforceable, the rest remain in effect. These Terms are the entire agreement between you and us regarding the site and Products — except for the open-source licence that accompanies the free version and any separate Pro licence terms, which govern the software itself — and they supersede prior understandings. Our failure to enforce a provision is not a waiver of it.
